Terms of Service

1. Acceptance of Terms

By creating an account or otherwise using ATC Trainer (the "Service"), operated by Wempe Works ("we", "us", "our"), registered address Kagerdreef 110, 2172 HM Sassenheim, the Netherlands (KVK: 42139457, VAT: NL004453574B53), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of the Service

ATC Trainer is a simulation-based training tool for practicing air traffic control procedures and phraseology, including shared multiplayer sessions where multiple trainees staff different controller positions (Ground, Tower, Approach, Center) over the same simulated airspace. It is provided for training and educational purposes only. It is not certified training equipment, is not affiliated with any air navigation service provider or aviation authority, and must never be used as a basis for real-world air traffic control decisions.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate information when registering and keep it up to date.

4. Organizations

If your account is a member of an organization, that organization's administrators may assign you scenarios and view your scores and session history for those assignments, as described in our Privacy Policy.

5. Subscription Tiers

The Service is offered under Free, Basic, and Pro tiers with different resource limits and features, as described on the Upgrade page. We reserve the right to change tier pricing, limits, or included features with reasonable notice to active subscribers. Paid subscriptions are billed and processed through Stripe, renew automatically until cancelled, and can be managed or cancelled at any time from your account's billing portal.

6. Acceptable Use

You agree not to:

• Reverse engineer, decompile, or attempt to extract the source code of the Service, except where applicable law grants you that right notwithstanding this restriction;
• Use the Service to store or transmit unlawful, infringing, or abusive content;
• Attempt to circumvent tier limits, authentication, or bot-protection mechanisms;
• Resell, sublicense, or provide the Service to third parties without our written consent.

7. Intellectual Property

The Service, including its software, design, scenario content, and documentation, is owned by Wempe Works and protected by copyright and other intellectual property laws. See the License page for the specific terms under which you're permitted to use it.

8. Voice Data

The Service processes recorded audio to transcribe your spoken commands and generate spoken readbacks, using speech recognition and synthesis that run on our own server. See our Privacy Policy for details on how this data is handled.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose. We do not guarantee the Service will be uninterrupted, error-free, or that training outcomes will meet any particular standard.

10. Limitation of Liability

To the maximum extent permitted by law, Wempe Works shall not be liable for any indirect, incidental, or consequential damages arising from your use of, or inability to use, the Service.

11. Termination

We may suspend or terminate your account for violation of these Terms. You may stop using the Service and request account deletion at any time via My Account → Personal Data.

12. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the Netherlands, without regard to conflict-of-law principles.
